I'll say it again, unlike Observer's comments in this thread there was no threat or instigation of violence.   

As to whether his rant is protected first amendment speech,  I think it is protected speech.     If you check the wiki article where Observer pulled the case law, since that 1942 ruling the court has narrowed the definition of what constitutes "fighting words".   the most recent ruling would seem to me view this guy's speech as protected under the first amendment:

Snyder v. Phelps, 562 U.S. ___ (2011), was a United States Supreme Court case in which the Court held that speech on a public sidewalk, about a public issue, cannot be liable for a tort of emotional distress, even if the speech is found to be "outrageous".

Um, you seem to forget the fact the terrorist already did kill people, by bomb and by gun.

Duh, this is not a point you were making I was supposed to admit to before now.   If you admit it it negates the ridiculous notion you are trying to make that the FBI should have been able to trace this guy immediately based in the pics.

I don't see how the boat owner is a hero.   He saw his plastic cover was off, he investigated, saw blood and a body and called 911.   He is being widely admired for refusing any donations for his boat and instead asking people to contribute to the victim fund.
