It's always pathetic when an intelligent person - as Gingrich is - abandons logic and fairness to play the populist demagogue.

Adoption agencies, Catholic or otherwise, that receive funding from the State or act as State agencies in any capacity cannot discriminate in ways that violate public laws and policies.

You'd fire a bus driver who refused to pick up Asians on his route, or a DMV worker who wouldn't issue a driver's license to a woman. The State has every right to "discriminate" in disseminating public funds and granting authority, on the basis of who is following the law and who is not.

--When government has the audacity to confiscate money from its citizens and redistribute it according to their whims, they cannot discriminate in ways that violate peoples constitutionally guaranteed rights.

By rights, I'm assuming (given the context and your proven proclivities) that you mean some "right to discriminate against [fill in the blank - mostly gay people]". What you need to understand is that when public funds and conferred government authority are concerned, that right doesn't exist. Discriminate all you like in your private life - even in your business, as far as I'm concerned, though the law may see it differently; when you do a job for the State, whether you're a bus driver or you're running an adoption agency, you don't have that luxury.
