What is your point? That a company would be so stupid to fire someone for working during lunch? Or that a fired person could get unemployment insurance? I am with the courts on this.  Pay the lady.

She wasn't fired for violating a rule - she was fired for refusing to comply with the direction of her superiors. She was given the opportunity to leave her desk and have the incident forgotten, and chose to refuse to do so.

Insubordination is a serious crime in the workplace.  Either you're in charge, or they are.  If you don't express your authority over your subordinates, YOU will be fired.
