The 4th Circuit threw out the challenge by claiming the state of Virginia lacked standing to bring the suit. They didn't address the constitutionality of the law.

As a minimum, key portions of the law will be nullified by the Supreme Court.

That is a good start.

They had to address the constitutionality if they considered if Virginia had standing.

It may not be "repealed," but on Day 1, every State in the nation will be issued waivers of it by a President other than Obama.

If it is so popular then why have thousands of waivers already been issues? The law was intened to cover the losers but wonder boy is discovering that there are a lot of winners out there that want no part of it.  When a socialistic labor union wants a waiver then that should tell you something.  Those sobs talk the talk but ain't about the walk the walk.
