The other consideration, one which has gone straight over your head is that you maintain the proposed facility isn't even a mosque. If that is the case, how can a law prohibiting its construction be a violation of the Free Exercise Clause? Either it is a religious facitility or it isn't.

You seem to have a reading comprehension problem. Nowhere in that quote does Gingrich mention law or legislation.
